1. Registration
ThemeJet is a Wordpress web page builder company, the software (themejet builder) provides our subscribers
the ability to alter their wordpress pages for a monthly payment of £3.99 or more dependng on the
chosen payment plan when signed up. Your use of this service and registration with us means you agree to these terms
or service, which are subject to change without notice, changes made to these current terms will not
apply or have any effect to disputes or events that have occured before the change is published; if you choose
to receive email messages regarding our updates you will be notified when a change to these terms has been made.
By becoming an active member and user of ThemeJet you agree that:
- You will not alter, copy, reverse engineer or redistribute any of our code unless given permission to.
- All information you have entered upon registration is accurate and will be kept up to date, you grant us
permission to store your personal information in our database.
- All information entered upon registration such as bank details is all yours and not someone else's
unless they have given you permission to use their personal details.
- You are responsible for keeping your login details safe so nobody else can gain access to your account
without your permission.
- We have permission to contact you via your email or through our website.
2. Subscriptions and Payments
You will be required to enter your payment information before gaining access to our web builder, as of yet
all payments are processed using Paypal and you will be billed on a monthly basis, please note we have the
right to change our prices at any time, you will be notified in advance if any changes affect your subscription.
Once you have submitted your payment information and have access to our paid service we are authorised to
request or collect money from a payment system, provider or your banking account as long as your membership
to ThemeJet remains active.
We do not offer refunds on any of our products unless stated so, if you have made a mistake paying for an
unwanted subscription plan or a product has been purchased through your account without your consent, we are
not obligated to refund any of your money back unless we have made the choice to after reviewing your request.
Taxes: We do not charge our customers taxes, however, you are responsible for payments of any applicable tax
such as value added tax, sales tax, goods and services tax etc. All taxes you are required to pay will be displayed
on the website (www.themejet.io) and added to the product price before a transaction is complete.
3. Termination
You may decide to stop using the themejet builder and permanently close your account or cancel a subscription with
us, during such event you will no longer have access to our paid services at the end of your subscription period.
If you registered with a paypal account you can also end your subscription through their website (www.paypal.com)
and the same rules would still apply.
Please note that we hold the right to suspend or terminate your access to any of our services for any or no reason
with or without notice, such action may be taken to your account if you have failed to pay any due fees or have
been caught or we suspect you are violating any of our Terms and Conditions.
If you decide to close your account with us all of your information will be removed from our system, this includes
any current subscription or previous purchases you previously made with us, so if you choose to re-create an account
with us none of your data may be retrieved from our databases. If for any reason we suspect you of breaching our
Terms and Conditions or have made the decision to close your account ourselves, we may also add all your information
to our 'blacklist', in which case we have the right to keep all data of blacklisted users for however long we see fit
in our system.
4. General
Any web design you have made using the Themejet Builder is all owned by you, this includes any videos, images, logos
or other media you have uploaded through the Themejet file uploader. We do not claim ownership over your content and
you agree that we can have access to your content or account data for any action we wish to take, this can be at any
time or date we find suitable with or without your consent and notice.
This service is based in the United Kingdom and shall be considered a website, web application or software that does
not cause any personal jurisdiction over ThemeJet, these Terms & Conditions shall only be governed by the internal
substantive laws of the United Kingdom. If you don't agree with the following or any of the terms in this page then
please do not create an account with us and leave our website.
You agree that any dispute or problem we have arising out of or related to this service, which requires lagal action
must take place in the United Kingdom and must also commence within one (1) year after the date of which the problem
we (you and us) have (had) begun, otherwise, our dispute shall be permanently closed.
If you agree to all of our Terms and Conditions and have made all payments for your selected products/services,
ThemeJet will grant you access to our services and an account, which you can then use to generate and store your
website's data in order to display or sell them (if offering your own products) to end users. Please note that certain
products available to you through our service such as images, fonts or plugins may not all be owned by us and might be
provided by a third party (such as Woocommerce or Unsplash); our users (you) are solely responsible for complying with
and not breaching any of the Terms & Conditions of the third party services we (ThemeJet) use for our products/websites.
5. Indemnity
We (ThemeJet) are exempt from any legal liability or other financial burden against all copyright claims, breach of
terms, damages, financial obligations, debt or costs that have emerged between any of our customers/users/subscribers
(you) and a third party that provides ThemeJet their services (Unsplash, Woocommerce, Font Awesome etc..). This includes
one of our users violating any of the Terms & Use of another service, or violation of a third party right such as
copyright, property, privacy and access rights or any other claim that has been filed against our users (you).
The same also applies for any other third party service that we (ThemeJet) have not included to our products, we are
indemnified from any of the claims listed in the previous paragraph that anyone files agains you, this also includes
any legal action initiated by your customers, a website owner, companies, small businesses or any other group/individuals.
6. Copyright and Trademark
All products and contents of services are copyrighted © 2022 ThemeJet. All rights reserved. You will not claim any
kind/sort of ownership over any of our products, our website and software (Themejet Builder) whether you have altered
the code, copied it's designs/functions or not done either. If you happen to come across a website or person/organisation
copying, reselling or imitating our service in any way (similar website name, website design, web page builder etc..)
please report them immediately to us via email or direct message, doing so would prevent hacking, unauthorised access to
user accounts, fraud and any other illegal cyber activity.
It would also be in your best interst to report another user you believe is stealing/copying your work directly to us
through email or a message on the website, we will try our best to review and take care of the situation as quickly and
efficiently as we can; when notifying us please provide the user's email, username or website url and also a description
of the work you claim to be infringing, thank you. When sending us this email/message you agree that you are the original
owner of the material you claim to have been copied and the user that has been complained of (by you) is not authorised
to use the copyrighted work, if we find out at any point that this is not true your account could be closed and we may
even fine you under penalty of perjury (or take the case to court if you refuse payments).
If your work has been copied or stolen, but the owner of the material that violates the copyright laws is not an active
member of our service (ThemeJet Builder) then there isn't anything we can do in such situation, you will be responsible
of taking matters into your own hands but please remember that if building a website with a template it could resemble
many others on the web, making it hard to prove plagiarism unless something you own such as a logo, images or content
have been used without your consent.
All products and services we (ThemeJet) sell are either owned by us or are authorised to use by a third party, you may
not copy, reverse engineer, imitate, redistribute or modify any of our code/products/website/software. If we find out
our content has been used without us authorising it (you) or you have violated one or more of our terms, then we will
either ask you to take down your copied material, close and blacklist your account, charge you a fine under penalty
of perjury or take this case to court.
7. User Account
Once you have created an account with us you can view your information after loggin in, change email preferences,
purchase different products, send us messages/reviews, have access to your data and more. You are responsible for
keeping your login credentials safe, if an unauthorised user where to gain access to your account they could purchase
products, change your login details and view your personal/website data or even perform actions that violate our Terms
& Conditions (such as downloading our products and redistributing).
You will be held responsible for any activity performed under your name/account, therefore, we recommend you do
not let anyone have access to your credentials. Whenever we detect another person is using your account we will notify
you as quickly as possible so you can tell us whether it's you or not, failure to reply may result in your account being
temporarily closed for as long as we see fit. Only one person is allowed per account so please refrain from using our
service in different machines or wordpress accounts to avoid confusion.
The information you provide us when registering (or updating your account) must be you own or your company's actual
contact or billing details, The actual owner of the account and/or user content will/may be verified by us using the
values submitted so please provide your actual valid e-mail address. In the event of disputes over account ownership
or even copyright law infringement claims, we will have to contact you and make a decision to determine ownership (of
account or website) to a user, we might also ask you to provide us with legal/identity documents to help assist us
determining ownership, if we cannot make a decision ourselves then we reserve the right to take whatever
action necessary such as closing the accounts of either or both parties disputing over the ownership of a material
until a decision has been made (by law or between yourselves).
8. User Obligations
Either yourself or the person signing up on your behalf agree that you (they) are of legal age in whichever country
you reside in to form a legal binding contract, your residence (or company's country of incorporation) must also
be the same as what's provided to us in your billing address. All content published on the world wide web is all
owned by you or your organisation, this includes files uploaded through our service such as images, videos, logos,
audio, animations, documents and any other material made under your account. As the owner of a ThemeJet account you
are responsible of ensuring your content is non-infringing upon any third party's terms of service, we are not
obligated to intervene in any lawsuits filed against you by any third party, nor shall we be responsible for any
outstanding fees you owe.
By using our service you agree that you will not attempt to damage our reputation in any way possible, submit
content that is seen as offensive to us or others; collect sensitive data on our users including login details
without a user's or our approval using illegal actions or not; copy, modify, reverse engineer any of our
code or design of either the website or digital products we make in order to distribute for free or sell our
material (altered or not).
You agree that we (ThemeJet) will have access and store your personal information in our system, you are aware and
accept the fact that you may/will be contacted through any of your contact details (preferably email address), if
you subscribe to our newsletter you'll also receive emails regarding any changes, updates, discounts, promotions or
general news we would like to share with our users. We also have the right to view/access your account and any of
your websites for the purpose of investigating, backing-up data, displaying or using your content with or without
your notice and permission.
9. Service Fees
All of our products/services that you purchase will be displayed in your account under the 'billing history'
section in the right panel of our website, unfortunately we do not issue invoices so you might have to check
with your payment service provider or bank statement for a digital copy of your bill. You will be charged a
monthly fee for our main subscription service, failure to do so could result in a warning to remind/notify you
if a transaction has failed or has not been received, in order to ensure you do not lose access to our web
page builder we may extend your payment period, if we still do not receive any outstanding fees you owe then we
have the right to suspend your account for however long we see fit (usually until collection of any fees owned);
in the meantime your website content will no longer be accessible on the web to your end users/customers,
neither will you have access to our web page builder or any other product you have purchased.
If we find out you trying to gain unauthorised access to our service through illegal actions such as modifying
our database to change your payment status, use a script, robot, automatic device or anything similar to either
use any of our products without paying for them, or acquire data on our other users in order to gain access to
their accounts/contents then we will permanently close your account and file a lawsuit against you or your company.
10. Third Party Plugins
Our web page builder might allow users to integrate and maybe even customise other third party wordpress plugins
like woocommerce with our service in order to allow you to create dynamic websites with back-end functionality,
we may also make modifications to these plugins when accessed with the ThemeJet Builder only for our user's
convenience only, we do not claim to own, have shared ownership, control or represent any of these plugins and
their services.
All our users are solely responsible for agreeing to any third party's terms and we (ThemeJet) are not liable or
responsible for any actions they perform with other services; our users should also note that we are not accountable
for any actions performed by these services. We will try our best to test everything works without any errors but
if you do find bugs then please report them to us via email, message or by leaving a review for whichever software
version the issue was found in, if there happens to be a problem with your site or your complaints by your end-users
due to our page builder not being fully compatible with whatever service is being used, you agree that we (ThemeJet)
shall not be held responsible for any damage caused to you or your company's reputation, finances and customers.
This could include issues with transactions, security, website SEO, performance, loss of data, incorrect information
displayed and more.
11. Disclaimer of Warranties
Our main product (ThemeJet Builder) is still a beta version which has been published for testing purposes, by using
our service you acknowledge that there may be faults, glitches, errors and performance issues while creating your
website on our platform; please report any issues you have so we can continue to improve our customer's experience
by leaving us a review. As part of our service we will also utilize other third party plugins to help our users
create functional websites, please note that you may also experience compatibility issues with our product and other
plugins, which could consequently affect your website's performance.
By using our service you accept the risk of data breach, data loss, website performance issues, glitches, compatibility
issues with third party plugins, bugs and any other inconvenience you face with your content and end-users, in the
occurence of such problems you agree that we will not be held liable for any damage this will cause you or your company.
